Welcome to Succly. These Terms of Service govern your use of our website and subscription services. By accessing our site or purchasing from us, you agree to these Terms.
1. Overview
Succly is a subscription service delivering live succulents and plant related goods from our farm in Fallbrook, California. All products are intended for personal, noncommercial use unless purchased through an approved wholesale agreement.
2. Subscriptions & Billing
By purchasing a subscription, you authorize recurring charges to your selected payment method at the frequency of your chosen plan. Your subscription automatically renews unless canceled prior to your next billing date.
Billing occurs on the date you originally subscribed and will continue on that same calendar date each month unless otherwise stated.
You may pause, skip, or cancel your subscription at any time through your account portal. Changes must be made before your next billing date to avoid being charged for the upcoming cycle. Once a renewal charge has been processed, it cannot be reversed.
If a payment fails, we may attempt to reprocess the charge. Shipments may be delayed or suspended until successful payment is received.
We reserve the right to update pricing, product offerings, or discontinue subscriptions with notice.
3. Orders & Shipping
Orders are shipped monthly. Exact ship dates may vary due to inventory availability, weather conditions, carrier delays, or operational factors. We do not guarantee delivery on a specific date.
Customers are responsible for providing accurate and current shipping information. Succly is not responsible for orders shipped to an incorrect address provided by the customer.
Responsibility for the package transfers to the customer upon confirmed delivery by the carrier.
Plant varieties may vary based on availability and seasonality.
4. Plant Guarantee
We take great care in packaging and shipping healthy plants. If your plant arrives damaged or nonviable, you must email us a clear photo within three (3) calendar days of confirmed delivery.
Claims submitted after three (3) days of delivery are not eligible for replacement or refund under our Plant Guarantee.
Because succulents are living plants, we are unable to evaluate plant condition or offer replacements for issues reported outside this timeframe. Environmental conditions, weather, carrier handling, and care after delivery are beyond our control.
Delivery issues, including lost, stolen, or misdelivered packages, must also be reported within three (3) days of marked delivery so we can initiate a carrier investigation.
Succly reserves the right to offer courtesy replacements or credits at its sole discretion. Courtesy accommodations do not modify this policy.
5. Returns & Refunds
Due to the perishable nature of live plants, all sales are final. Refunds are not provided once an order has shipped, except as outlined in our Plant Arrival Guarantee.
6. Gifting
If you purchase a subscription or box as a gift, you are responsible for providing accurate recipient details. Gift purchases are final sale and nonrefundable once shipped.
7. Intellectual Property
All content on this site, including images, branding, product designs, graphics, and text, is the property of Succly and may not be used without written permission.
8. Limitation of Liability
To the fullest extent permitted by law, Succly shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website, products, or subscription service.
Succly is not responsible for plant condition or survival after delivery confirmation, including issues caused by weather, carrier delays, theft, improper care, environmental factors, or customer handling.
In no event shall Succly’s total liability exceed the amount paid for the specific order giving rise to the claim.
9. Force Majeure
Succly is not liable for delays or failure to perform resulting from events beyond our reasonable control, including natural disasters, extreme weather, carrier disruptions, supply shortages, labor disputes, or governmental actions.
10. Chargebacks & Disputes
By purchasing from Succly, you agree to contact us directly to resolve any billing concerns before initiating a chargeback with your financial institution. Failure to properly cancel a subscription prior to renewal does not constitute grounds for chargeback.
